Postal Status Of PAN CARD – पैनकार्ड की डाक स्थिति

When the new, corrected or reprinted card is finally printed, it is dispatched by  Speed Post / Registered post  of Indian Post  or by A-class private couriers. Generally,  pan cards related to big towns / cities (served by A class Couriers) are dispatched by the couriers and to other places, pan cards are sent  / dispatched by Speed Post / Registered post of Indian Post.

PANCARD FOR PROPRIETORSHIP CONCERN – NOT POSSIBLE / प्रोप्राइटरशीप / मालिकी फर्म अलग से पेनकार्ड संभव नहीं

हमें  कई प्रोप्राइटरशीप / मालिकी फर्म  के  नए पैन कार्ड के लिए कई आवेदन प्राप्त  होते  है , लेकिन  आयकर अधिनियम, 1961  के प्रावधानों के अनुसार  प्रोप्राइटरशीप / मालिकी फर्म को कोई स्वतंत्र दर्जा प्राप्त  नही है  और इसलिए प्रोप्राइटरशीप / मालिकी फर्म  के  लिए अलग से  पैन कार्ड नही  मिलता है ।सभी व्यावहारिक उद्देश्यों के लिए मालिक का  पैन नंबर ही प्रोप्राइटरशीप / मालिकी फर्म  का  पैन कार्ड, व  पैन नम्बर होता है ।
We receive many applications for new pan card of proprietorships / proprietorship firms / proprietorship concerns but  proprietorship / proprietorship firm / proprietorship concern has no independent status as per provisions of Income-tax Act, 1961 and therefore, no pan card can be applied / prepared / obtained for a proprietorship / proprietorship firm / proprietorship concern independently.
For all practical purposes, the PAN Number of the proprietor of that  proprietorship / proprietorship firm / proprietorship concern will also be the PAN of that proprietorship / proprietorship firm / proprietorship concern .
Many educated people and even some bankers also ask / demand sometimes for PAN / Pancard of proprietorship / proprietorship firm / proprietorship concern  which is total wrong and impossible. No doubt, partnership Firm, Company, HUF, Association has separate PAN but for income-tax purpose, proprietor and his proprietorship / proprietorship firm / proprietorship concern is only one person.
Even an individual,  a partnership Firm and a company can have it’s  more than one proprietorship / proprietorship firm / proprietorship concern but PAN remains always only ‘ONE’ that too in the name of  proprietor and in the name individual who is proprietor of the proprietorship concern.

Procedure and Steps for Processing of New PAN Application in Form 49A / 49AA

An application for new / fresh PAN card is processed step by step and for that following procedure and steps are followed if application is processed by NSDL e-Gov. :-

 1. As per the procedure prescribed by the ITD, the application for allotment of PAN is required to be made in Form 49A (form 49AA for non-citizens of India ).

 2. A duly filled aforesaid application form along with prescribed documents [Proof of Identity (POI), Proof of Address (POA) and Proof of Date of Birth (PODB)] has to be submitted by the application at the nearest  TIN-Facilitation Centers and PAN centers.

 3. Such application can be sent / submitted directly or through any online/offline service provider and personal attendance of the applicant is not required.

 4. Application processing fee (inclusive of service tax) is payable.

 5. The Tin-Facilitation center / PAN centre ensures that the mandatory fields in the PAN application form are  complete and copy /(ies) of the prescribed supporting documents  [Proof of Identity (POI), Proof of  Address (POA) and Proof of Date of Birth (PODB)] indicating details (i.e. Applicant Name, Address,  Date of Birth etc.) as mentioned in the application form are submitted by or on behalf of the applicant  along with the PAN application.

 6. In case, any discrepancy is found in the application form and / or supporting documents submitted  by or on behalf of the applicant, the application will be rejected by TIN-Facilitation Centre / PAN  Centers. The discrepancy observed in the PAN application will be intimated to applicant personally or at the  address mentioned in the application and non- acceptance memo is also issued. In any condition, defective  application is not accepted / processed by the TIN-Facilitation Centre / PAN Centers.

 7. On successful completion of the scrutiny by TIN-Facilitation Center, a 15 digit acknowledgement is issued in  the name of applicant by the TIN-Facilitation Centers.

 8. After acceptance of application by issuing issuance of 15 digit  acknowledgement, the PAN application is digitized  and validated by TIN-Facilitation Centers.

 9. Thereafter, application is again scrutinized by the controlling office of the TIN-Facilitation Centre and in  case, any discrepancy is found in the application form and / or supporting documents attached to the application by  the controlling office, the application will be kept on hold until the defects are removed by the TIN-FC and reasons  for keeping on hold are intimated to concerned TIN-Facilitation Centre . After removal of defects by the TIN-FC,  application is forwarded to Central System of NSDL e-Gov. where application is again scrutinized.

 10. In case, any discrepancy is found in the application form and / or supporting documents attached to the  application by the Central System of NSDL e-Gov., the application will be again put on hold by the Central System of  NSDL e-Gov. and the discrepancy / defect observed in the PAN application will be intimated online as well as offline  to applicant at the address mentioned in the application . The application is further processed only upon receiving  the prescribed documents/complete information to match the application/request for PAN Card received from or on  behalf of the Applicant.

 11. After the satisfaction and clearance of NSDL e-Gov.,  NSDL e-Gov. forwards the application / data  to the Income  Tax Department (ITD) for allotment of PAN (Permanent Account Number) which is allotted by the ITD only.

 12. After the satisfaction and clearance of Income Tax Department,  PAN (Permanent Account Number)  is allotted  by the Income Tax Department and communicated to NSDL e-Gov. for printing and dispatching the PAN Card to  the applicant through courier / postal services.

 13. Finally, PAN Card is dispatched and delivered to the applicant only through courier / postal services on given  address.

 14. In case of non-delivery or mis-delivery of pancard or return of pan card, applicant can make request for ensured  delivery of pan card by sending the e-mail at tininfo@nsdl.co.in .

 15. In case of any defect relating to data and photo on pancard, applicant can make request / complaint for correct  pan card by sending the e-mail at tininfo@nsdl.co.in .

AADHAR CARD – VALID DATE OF BIRTH PROOF ALSO FOR PANCARD PURPOSE SINCE 17.04.2015

Ultimately, Modi Govt. took the care of poor public of India in respect of pancard problems by simplifying the relevant rules. We also made the request to the Govt. of India to liberalise the rules relating to Date of Birth for pan card application.

We are thankful to this Modi Govt. who took the note of this problem and allowed Aadhar card as a valid proof of Date of Birth (DOB) for pancard purpose provided Aadhar Card contains the Date of Birth of the applicant.

It means that an Aadhar card without Date Of Birth is meaning less for the purpose of proof of Date Of Birth.

There was a problem in relation to  Birth date of Pan Card Applicant. This problem was serious for those applicants who are not having any proof of affidavit.  It is more serious for old aged persons and illiterate persons.  Therefore, now government of India has allowed BIRTH DATE AFFIDAVIT as proof of BIRTH DATE AFFIDAVIT FORMAT FOR PAN CARD.

How To Get Fast Pan Card and quickly ?

How one can get fastest new pancard, correction pancard or Reprint of Pancard and which company issues fastest pancard, such questions are always raised but these are not correct questions but question should be ,”Who can get fastest PANCARD’ ?

An applicant with perfect application with perfect Ids, gets the fastest pan card and therefore, important is correct (Non-defective) application and not the company. Other factor is support of service providers. Therefore, while filling the application online or off line or sending the hard copy of application to your service provider, you should keep following things / rules in mind :-

* Name in Application should exactly matching with Ids.

* Application should be supported by valid proof of Date Of Birth.

* Address in application should match materially with valid address proof.

* Photos should be pasted only and not to be pinned / stapled.

* Photos should be good, latest, colored, front faced and clear from head side with light back-ground.

* Signatures should be made at proper places in black ink and signatures should not touch the borders of Boxes.

* Thumb Impression should be attested by Notary Public but right hand side photo should remained untouched by signature, Thumb Impression and Notary.

* In case of minor, application should be singed by parents with Ids of parents but DOB proof of minor himself.

* Before despatching the hard copy, all guidelines should be read and list of valid Ids should be checked at http://pancard.org.in/requirement-id-address-and-date-of-birth-proofs-for-pan-card-application/ .

* Ensure the delivery of hard copy with Couriers, otherwise avoid Couriers and applications should send the hard copies of applications by Registered Post preferrably.

* Take guidance in advance from the Service Provider or TIN-FC.

Every Indian citizen including Senior Citizens, Rural Persons and illiterate persons can apply for Pan Card in India.

Precautions for Illiterate Applicant : All other formalities are same for all applicants but in case of an illiterate applicant of pan card, he will have to put his/her thumb impressions at total three places instead of signatures. First Thumb Impression should be put on left side photo (Half on photo and half on paper but not on face ) and should be attested by NotarySecond Thumb Impression should be put within the box below the right-hand side photo but without attestation by NotaryThird Thumb Impression should be put within the box at the bottom of application on the right-hand and should be attested by Notary.

Identity Proofs : Like Others, illiterate applicant of pan card will also require to submit original or copies of personal identity Proof, Address Proof and Proof of address as case may be. All these Ids and proofs are prescribed by Govt. Of India and therefore, these should be prescribed proofs only. Main Problem of Proof Of Date Of Birth :  Generally, all the Senior Citizens, Rural Persons and illiterate person in India do not have any proof of date of birth. Date of Birth mentioned in Aadhar Card and Notarised affidavit are also not eligible and therefore, it is very problematic for such Senior Citizens, Rural Persons and illiterate persons for getting the pan card. since, 03.02.2014, it has become very difficult to get the proof for pan card as the applicants have very limited options. Particularly senior citizens, non-matriculate persons and rural Indians have great problem as average Indian don’t have any birth certificate. But now, Aadhaar Card and Notarised affidavit are eligible as proof Date of Birth .

However, Govt. has allowed affidavit for date of birth but it should be sworn before a magistrate of any kind / rank which is almost an impossible task as no magistrate likes this job and therefore, average Indian is unable to get Magisterial affidavit. Generally, Tehsildar , Nayab Tehsildar and Deputy/Asstt. Tehsildar are also Executive Magistrate but in their official seal, ‘Magistrate’ word should be there and such  Tehsildar , Nayab Tehsildar and Deputy/Asstt. Tehsildar can be approached through any document writer or advocate.  General public and public representatives should request / represent the Govt. Of India that Notarised Affidavit and/or Certificate of Gazetted Officer should be allowed as proof of date of birth for all the Indian citizens.  But now,  Notarised affidavit is eligible as proof Date of Birth .

PANCARD FOR ONE PERSON COMPANY – OPC

Status of OPC is a new thing in India but each OPC (One Person Company) compulsorily requires PANCARD and each OPC can also apply pancard online through www.pancard.org.in only with copy of it’s Registration / Incorporation Certificate.

Application will be made in same Form No. 49A with the status of company. Application for pancard can be made online or offline. No photo graphs of director is required but total 3 signatures are required on hard copy of application with out photos) as per given on sample form at http://pancard.org.in/pan_forms/pan-sample-form.jpg and OPC’s status will be treated ‘Company.

NEW PAN CARD GROWTH REDUCED BY MORE THAN 50%

Till 02.02.2014, Date Of Birth declared by applicant of New Pan card was being accepted but rules for pan card were made harsh and very hard particularly relating to proof for Date Of Birth since 03.02.2014 by the  Man Mohan  Govt .  and  since 03.02.2014, options  for proof for DOB were made  limited very irrationally which resulted in to decrease in growth of pancard in India.

During the February, 2013NDSL received total 17,76,999 applications and 18,20,048 applications in January 2014 which were reduced to only 7,75,540 (Reduced by about 57%). Likely,  during the February, 2013, NDSL and UTIISTL both received total  29,48,044  and 29,86,221 applications in January 2014 which were reduced to only 14,26,443 (Reduced by about 53%) for new pan card .

By these new irrational rules, illiterate, rural and senior citizens are badly effected and are being rather penalised for their illiteracy and seniority. It seems that Govt. does not like this growth in new pan card and therefore, it put the restrictions. Such irrational conditions for DOB increased the corruption and cost of pan card. Now, all indians are expecting  simplified rules and procedure for new pan card from present popular Modi Govt. which could not put it’s attention towards this problem.

An affidavit sworn before any Notary Public is accepted by any magistrate and even by High courts but very surprisingly, an affidavit sworn before any Notary Public for the purpose of Date Of Birth, is not accepted ay Income-tax Department which is a total unjustice against  illiterate, rural and senior citizens.

PERFECT ID PROOFS FOR PAN / PAN CARD

For an application for Permanent Account No. (PAN) and/or PAN CARD and/or Correction in Pancard and/or Reprint of Pancard and/or reissue of Pancard and/or second original pancard by an individual in India, applicant will be required to submit 3 (three) proofs or copies of 3 (Three) proofs such as Photo Identity Proof, Address Proof (POA) and Proof for Date Birth (DOB) and Income-tax Depaertment of Govt. Of India has prescribed a long list of such eligible / valid proofs.

Some proofs are valid for one purpose and some proofs are valid for two purposes but some proofs are valid for all the three purposes which are actual Perfect Proofs. It is advisable to all the applicants through www.pancard.org.in and www.etdsdsc.com that they should use any one of such Perfect Proofs for fast disposal of their application (If they have) . But unfortunately, only two Perfect proofs are prescribed by the Govt. Of India.

As per Govt. Notification, followings two are the perfect Identity proofs for Personal Photo ID, Address Proof and Proof for Date Of Birth (DOB) and one photo copy of such perfect Id is sufficient for all the three purposes :-
